New report on fundamental rights in the EU: More political courage needed, say MEPs

Today the European Commission issued the first Annual Report on the Application of the EU Charter of Fundamental Rights. The EU’s own ‘Bill of Rights’ lays down a binding legal framework to protect human rights in the European Union, including non-discrimination on grounds of sex and sexual orientation.

Justice Viviane Reding, Vice-President of the European Commission in charge of fundamental rights, has delivered on her pledge to analyse the EU’s human rights regime every year.

Members of the European Parliament welcomed the exhaustive overview of the Commission’s work on fundamental rights. However, some also regretted that the Commission sometimes failed to voice stronger concern for fundamental rights by speaking out publicly and taking legal action.

Raül Romeva i Rueda, Vice-President of the LGBT Intergroup and MEP in charge of a draft Europe-wide anti-discrimination Directive, reacted: “This report shows the EU plays a fundamental role in safeguarding human rights. The European Parliament has repeatedly asked that the Commission take action to protect these rights, and it’s essential that President Barroso and Vice-President Reding keep pressing for this new anti-discrimination Directive.”

Michael Cashman MEP, Co-President of the LGBT Intergroup, added: “This report gives a good overview of how the Commission worked to bolster fundamental rights in the EU last year, and I applaud the work undertaken by Viviane Reding.”

“But Commissioners have been far too hesitant at times, and failed to show leadership in particular when a European consensus did not exist, such as on LGBT people’s fundamental rights.”

“While we must—and will—work together on applying the Charter within the limits defined by the Treaties, the Commission must also be firmer and quicker when reacting to injustice, both legally and politically.”

The European Parliament will now provide the Commission with comments on this first annual report.

European Parliament calls for special protection of LGBT asylum-seekers

Members of the European Parliament voted today to modernise the EU-wide system for examining asylum claims. Among the measures adopted today, groups of asylum-seekers with special needs were updated to include people fleeing persecution based on their sexual orientation or gender identity.

Sylvie Guillaume MEPIn a report drafted by French centre-left MEP Sylvie Guillaume (Socialists & Democrats), the European Parliament adopted a series of amendments to guarantee that lesbian, gay, bisexual or transgender people seeking asylum in the EU would receive particular attention.

Measures include providing expert advice to asylum officials on sexual orientation and gender identity; protecting claimants’ privacy; guaranteeing that physical examinations fully respect human dignity and integrity, for instance in cases involving minors or transgender people; and ensuring that applications by LGBT asylum-seekers are not ‘fast-tracked’ for removal to their country of origin.

Sirpa Pietikäinen, Member of the centre-right European People’s Party and Vice-President of the LGBT Intergroup, commented: “I am particularly proud that my centre-right colleagues agreed on the need for special protection, regardless of their general position on asylum. Lesbian, gay, bisexual and transgender people fleeing countries such as Iraq, Uganda, Honduras or Indonesia must receive particular protection taking into account cultural sensitivity. This is a major step towards fully complying with our engagements under international asylum law.”

Rui Tavares MEP, Civil Liberties Coordinator of the left GUE/NGL political group and Vice-President of the LGBT Intergroup, added: “The European Parliament is showing that asylum rules need updating to reflect reality: 76 countries criminalise homosexual acts, and 7 foresee the death penalty (maybe 8 soon with Uganda). I regret that other progressive provisions did not pass, but today’s text will ultimately bring more fairness for LGBT asylum‑seekers.”

The text adopted today is the European Parliament’s formal position at first reading. Asylum rules will effectively be amended once EU governments examine the text and conclude an agreement with the European Parliament.

President of the European Parliament marks International Day Against Homophobia and Transphobia
European Parliament Intergroup on LGBT Rights
May 11th, 2011

Yesterday, President of the European Parliament Jerzy Buzek inaugurated a photo exhibition on European gay prides. The Polish centre-right President addressed Members of the European Parliament, staff and visitors. Mr Buzek said homophobia was “deplorable, because it aims to denigrate people and deprive them of their rights on the basis of their sexual orientation.”

Jerzy Buzek officially marked the International Day Against Homophobia for the first time in 2010 via a video message.

The President of the European Parliament was joined by Members of the European Parliament Ulrike Lunacek and Michael Cashman, Co-Presidents of the European Parliament’s Intergroup on LGBT Rights, and Charles Meacham, author of the photographs.

Walk With Pride exhibitionAfter the event, Michael Cashman and Ulrike Lunacek reacted: “We are proud to be members of a Parliament that represents 500 million Europeans, and which stands ready to defend the human rights of lesbian, gay, bisexual and transgender people. The genuine and heartfelt engagement of Jerzy Buzek, a Polish centre-right President demonstrates that homophobia no longer belongs to mainstream EU politics. We are grateful to Mr Buzek and all our colleagues for helping LGBT people live their lives freely, and without fear.”

Since 2006, the European Parliament adopted five resolutions demanding that LGBT people’s human rights be respected in Europe, reminding EU countries that banning pride marches breaches the European Convention on Human Rights. Over 180 European pride marches will take place in 2011, from Iceland to Malta and from Portugal to Russia.

The exhibition contains 20 images by award-winning photographer Charles Meacham, from New York. The photographs will be shown in over 20 locations around the world, starting in the EU Parliament from 9 to 12 May.

SÃO JOÃO DEL-REI: MANIFESTO DA I MARCHA MUNICIPAL CONTRA A HOMOFOBIA

PELA INSTITUIÇÃO DE POLÍTICAS PÚBLICAS DE PROMOÇÃO E DEFESA DOS DIREITOS HUMANOS LGBT

Igualdade de direitos. Fim da discriminação. Fim da violência. Cidadania plena. Reconhecimento. Respeito. Essas são as nossas reivindicações. Somos milhares de São-Joanenses, ainda excluídos da democracia e  sem seus direitos garantidos pelas leis do país e das políticas públicas municipais.

No Brasil exigimos a aprovação imediata do PLC 122 que punirá na forma da Lei, os crimes resultantes de discriminação ou preconceito de raça, cor, etnia, religião, origem, condição de pessoa idosa ou com deficiência, gênero, sexo, orientação sexual ou identidade de gênero no âmbito nacional. Exigimos também a aplicação das Leis Municipais de proteção pessoas LGBT contra a discriminação, coerção e violência sofrida por nossa população. Queremos a implantação de políticas públicas municipais de promoção e defesa dos direitos humanos.

Somos lésbicas, gays, bissexuais, travestis e transexuais (LGBT) de todas as profissões, de todos os credos, de todas as raças, de todos os sotaques, de todas as opiniões, de todas as etnias, de todos os gostos e culturas. Mas temos algo em comum. Não usufruímos nossos direitos pelo simples fato de termos orientações sexuais ou identidades de gênero diferentes da norma sexual dominante. Somos milhares de cidadãos e cidadãs de “segunda classe”  em nosso Brasil.

Faz 22 anos que o Brasil se democratizou e promulgou a “Constituição Cidadã”. Entretanto, em todo esse período, nossa jovem democracia não foi capaz de incorporar a população LGBT. Até hoje não existe sequer uma lei que assegure nossos direitos civis. Não existem leis que nos protejam da violência homofóbica.

A homofobia não é um problema que afeta apenas a população LGBT. Ela diz respeito também ao tipo de sociedade que queremos construir. O Brasil só será um país democrático de fato se incorporar todas as pessoas à cidadania plena, sem nenhum tipo de discriminação. O reconhecimento e o respeito à diversidade e à pluralidade constituem um fundamento da democracia. Enquanto nosso país continuar negando direitos e discriminando lésbicas, gays, bissexuais, travestis e transexuais não teremos construído uma democracia digna desse nome.

Por essa razão é que o Movimento Gay da Região das Vertentes, convoca seus afiliados, pessoas e organizações aliadas à I MARCHA MUNICIPAL CONTRA A HOMOFOBIA PELA INSTITUIÇÃO DE POLÍTICAS PÚBLICAS MUNICIPAIS DE PROMOÇÃO E DEFESA DOS DIREITOS HUMANOS LGBT, a ser realizada na cidade de São João del-Rei, Minas Gerais, em 17 de maio de 2011, com concentração às 14h, na Avenida Tancredo Neves, em frente à Caixa Econômica Federal.

O dia 17 de maio é comemorado como o dia municipal (Lei N 4.442/10) contra a homofobia (ódio, agressão, violência, discriminação e até morte de LGBT). A data marca uma vitória histórica do Movimento LGBT internacional. Foi quando a Organização Mundial de Saúde retirou a homossexualidade do Código Internacional de Doenças. O Decreto Presidencial de 04 de junho de 2010 incluiu o Dia Nacional de Combate à Homofobia no calendário oficial federal.

Vamos às ruas de São João del-Rei, novamente, para denunciar a homofobia, o racismo, o machismo e a desigualdade social. Temos assistido nos últimos meses ao recrudescimento da violência homofóbica em todas as Unidades da Federação. Chama a atenção o fato de que muitos dos agressores não pertencem a grupos de extermínio e envolvidos em crimes de  ódio, mas são jovens de classe média, o que demonstra como a homofobia está amplamente difundida em toda a sociedade.

O Brasil é um país plural, diverso e nossa São João del-Rei também, que respeita todos os credos e religiões, contudo nosso Estado é laico – separamos a religião da esfera pública, isso está garantido constitucionalmente. O movimento LGBT defende a mais ampla liberdade religiosa. Respeitamos todos os credos e opiniões, mas, entendemos que crenças religiosas pertencem à esfera privada - individual ou comunitária. Religião é uma escolha, a cidadania não! A Cidadania é um direito fundamental!

Não aceitamos que argumentos de religiosos homofóbicos sejam usados como justificativas para o preconceito e negação de direitos aos LGBT. É preciso assegurar a laicidade do Estado e garantir o respeito à diversidade.

A I Marcha Municipal Contra a Homofobia é, portanto, um grito, um protesto, uma exigência para a instituição e implementação imediata de políticas municipais de proteção dos direitos humanos, um manifesto de respeito aos direitos individuais e coletivos.

Queremos igualdade de direitos e políticas públicas de combate à homofobia. Reivindicamos que o Estado brasileiro, de conjunto (ou seja, os três poderes), e em todas as esferas da federação (União, Estado e Municípios) incorporem a diretriz de combater a homofobia e promover a cidadania plena para a população LGBT.

Reivindicamos que:

- Congresso Nacional aprove a criminalização da homofobia (PLC 122), a união estável / casamento civil; a alteração do prenome das pessoas transexuais, o reconhecimento do nome social das travestis;

- Estado laico seja assegurado, sem interferência de religiosos homofóbicos;

- Governo Federal acelere a implementação do Plano Nacional de Promoção dos Direitos Humanos e Cidadania de LGBT, garantindo recursos orçamentários e o necessário controle social na sua execução, promovendo a diminuição da homofobia;

- O Governo Municipal institua: coordenadoria LGBT, Conselho LGBT e Plano de Combate à Homofobia;

- Os  Governo Municipal acelere a criação e implementação  do Plano Municipal de Enfrentamento da AIDS para gays e outros HSH, Travestis, Lésbicas e Transexuais, garantindo recursos orçamentários e o necessário controle social na sua execução, promovendo a diminuição da  infecção  do  HIV   em nossa   comunidade;

- O Governo Municipal institua uma Secretaria Municipal de Proteção e Promoção dos Direitos Humanos com foco em políticas públicas nos grupos vulneráveis: mulheres, negros, população privada de liberdade, LGBT, população de rua, juventude entre outros.

- O Governo Municipal nomeie, emergencialmente, o Conselho Municipal de promoção e proteção dos Direitos Humanos, criado por lei no ano de 1.999 e não nomeado até hoje.

- Sejam tomadas medidas concretas pelas autoridades competentes para diminuir os casos de assassinato, violência e discriminação contra as pessoas LGBT.
